Details: | SUMMARY: Discussed administrative order issued on 8/4/2009 DETAILS: I spoke with John Lund regarding the administrative order issued to the Lees Camp water system. Mr. Lunds primary concern is that everyone is treated equitably, and that water supplied to Randy Loftesness be required to meet the same drinking water standards as his water. He believes that Randy Loftesness does use the water from Lees Camp for domestic purposes and not just for irrigation and fire suppression as was stated by Mr. Loftesness. He also stated that the local groundwater has taste and odor issues and most people prefer to drink the surface water. Randy Loftesness did make the statement on 8/12 that the creek water is "good water," and that he drinks directly from the Wilson River occasionally, and that the practice is perfectly safe, which suggests that he would not be concerned with using the Lees Camp water. I am left trying to determine whether or not Randy Loftesness does actually use Lees Camp water for domestic purposes. John Lund is also concerned that he may be susceptible to a lawsuit if he was to actually disconnect Mr. Loftesness from the water system due to water rights issues. He does believe that the property owned by the Loftesnesses is not party to the certificate for the original water right which covers Lees Camp. I informed Mr. Lund that our primary concern was safe drinking water, and that the standards will be applied to everyone who is part of the Lees Camp water system, including Mr. Loftesness if he is indeed using the water for domestic purposes. ACTION NEEDED: Call Greg Beaman and determine water right situation. Also try to determine whether the Loftesness property uses domestic water provided by Lees Camp so we can include them as recipients of the administrative order if appropriate. |
