Details: | SUMMARY: Complaint investigation regarding potential contamination of PWS 41-06127. DETAILS: Received complaint on 07-19-10 regarding the construction of a horse pen that may serve as a potential source of contamination for the above water system. Conducted a site and formal investigation on 07-21-10. The property where the horse pen is being constructed id not part of the public water system and the horse pen is well beyond the 100ft. Setback required of an animal feedlot/grazing pasture. However, per the contract rules of the homeowners association, a horse pen is not allowed. The identified property where the horse pen is being built also does not fall under the jurisdiction of the state drinking water rules. Given the on-ground situation, informed complainant there was little from a drinking water perspective the LPHA could do in terms of preventing the horse pen from being built. Reiterated to continue quarterly testing of water ( and stated they could do monthly if that would make them feel better) for monitoring purposes. The complainant will pursue this case from a legal standpoint and the contract rules of the homeowners association. No further action will be taken by the JoCtyPH, but will continue to monitor samples as they come in and working the PWS on an as needed basis. ACTION NEEDED: none |
