Details: | SUMMARY: Phone call re: letter sent for violations DETAILS: We drafted a letter to the water system regarding the accrued violation for failure to collect and report and annual source water assessment water test for microbiological contaminates at each source (well). We phoned the operator to explain the letter.In addition to discussing the source water assessment monitoring, we also discussed their 2012 Lead & Copper sampling. One of the 10 copper samples exceeded the MCL. Following a consultation with the DWP, we informed the operator that only the 90th percentile is counted-- the highest 10% of samples are discarded for regulatory purposes.Further, we discussed their Nitrate sampling during the 2012 monitoring period. In May, 2012, the operator collected Nitrate samples at each source (rather than the entry point). These samples were not counted toward their required ‘Entry-Point’ monitoring requirements. Since this water system does not treat the water (except for chlorine residual), we recommend that the state accept those samples from last year and rescind the violation. We believe that the source samples are representative of the ‘entry-point’. ACTION NEEDED: The operator was directed to either immediately collect assessment source samples for microbiological contaminates at each well source, or submit evidence that samples were taken during 2012. They will still need to collect 2013 samples for Nitrate either way.The operator was directed to disregard the single MCL for copper from their last sampling series. There is no further action required.The operator was directed to take their next Nitrate samples during May of 2013 regardless of the determination to either invalidate the violation or not. They were also directed to collect future Nitrate samples from the ‘Entry-Point’ to the distribution system (two tests that are representative of each source). |
