| Details: | SUMMARY: Discussed civil penalty settlement DETAILS: I spoke with Bobbie Bolden, and she stated that they are willing to enter into a settlement agreement, and are requesting an additional 90 days to complete the actions specified in the original Notice of Violation. I informed her that they would be required to pay 10% of the assessed penalty ($100 in this case) and that they would waive any opportunity for a hearing or further judicial review in the matter. She said they are agreeable to all of those stipulations. Bobbie stated they are considering drilling a well to escape the overly-burdensome surface water regulations. I suggested she call Tom Pattee or consult with a Geologist before they commit to a well, due to the possibility that the systems proximity to Fahy Lake and the ocean result in the only well water available at their location being under the influence of surface water. ACTION NEEDED: I will begin drafting a settlement for review by the Boldens and staff. | ||
