Details: | SUMMARY: Haven Acres DETAILS: Gary Leinonen called to discuss the dispute over the Haven Acres water system. He said that he was one of the 4 original partners of Seaton Enterprises and in 1968, the City was asked to provide water to the development. The City agreed to provide the water, but did not have the funds to install the distribution system, so Seaton Enterprises agreed to put in the system. The City installed the meters and charged water rates beginning with the first service in 1968. Seaton Enterprises charged a connection fee until the City began charging SDCs (sometime in the 1980s according to the City). We discussed the Potter Road agreement between Gary and the City dated January 29, 2003, in which Mr. Leinonen was to continue operation and maintenance of the pump station and the Haven Acres Water Distribution System. Gary said that the agreement did not identify who was to pay for said maintenance (the City does not pass the money collected for water rates to Gary). Gary said that he is unable to maintain the system. I told him that, after a conference call held on April 12th 2010 between the Assistant AG Shannon OFallon (ODOJ), Chris Hughes (DWP) and Joe Carlson (DWP), it was agreed that the Shannon would contact the Citys attorney to discuss the matter and then provide DWP with further instruction based upon those discussions. I asked Gary about a letter he sent to the City stating that he was unable to maintain the system and he said he would fax me a copy, along with the bills he received for the repairs made to the broken mains this month. I told him I would fax him the Sept 29, 2009 letter from Chris Hughes to David True with the City and the letter dated February 3, 2009 from Dave True to Brad Daniels, DWP Enforcement Coordinator. ACTION NEEDED: DWP to keep Gary aprised of further developments. |
